On December 11, 2023, in State v. Herrick, the Minnesota Court of Appeals affirmed the conviction of appellant for violating Minn. Stat. 169.21, subd. 5 for walking on a roadway when sidewalks are provided and are accessible and usable. Appellate attorney Alina Schwartz successfully argued that the district court did not err indetermining that the median is part of the roadway for purposes of enforcement of Minn. Stat. 169.21 subd. 5.
