On May 20, 2024, the Minnesota Court of Appeals in City of Plymouth v. Kristensen affirmed a code enforcement action involving a homeowner who built an illegal berm, which prevented the proper drainage of storm water across their property. After the City won summary judgment in the district court, the homeowner appealed arguing the district court misinterpreted the city ordinances and state laws. Campbell Knutson attorneys Jack Brooksbank and Jared Shepherd handled the appeal on behalf of the City. The Court of Appeals affirmed the district court’s order, rejecting the homeowner’s arguments as invalid or not properly raised and determining that the City was entitled to injunctive relief addressing the code violations.
