On August 4, 2021, the Minnesota Supreme Court issued its decision in State v. Hatch, an important ruling addressing constitutionality of the Minnesota carry-to-permit law.  Campbell Knutson Attorney Alina Schwartz wrote an amicus brief for Suburban Hennepin County Prosecutors Association in support of the State’s position, arguing that the law does not violate the Second Amendment to the United States Constitution.  The Minnesota Supreme Court concluded that the statute withstands strict scrutiny because it serves compelling governmental interest in ensuring public safety and is narrowly tailored to achieve that interest.  Therefore, the court held, the permit-to-carry statute does not violate the Second Amendment to the United States Constitution.
